TN MANAGEMENT CONSULTANT
A Management Consultant is a consultant or an advisor to a company’s management engaged to help research, identify and/or resolve a particular operational or management issues or problems or improve efficiency, etc. For TN purposes the applicant for TN visa under this category can only provide reports, studies, advisory opinions, make recommendations, etc. The TN applicant is not the one who “implements” any recommendations.
As NAFTA defines the category: Management Consultants “provide services that are directed toward improving the managerial, operating, and economic performance of public and private entities by analyzing and resolving strategic and operating problems and thereby improving the entity’s goals, objectives, policies, strategies, administration, organization, and operation.”
Management Consultants are usually independent contractors or can be employees of consulting firms under contracts to U.S. entities. Management Consultants may be salaried employees of the U.S. entities to which they are providing services only when they are not assuming existing positions or filling newly created positions. As a salaried employee of such an U.S. entity, they may only fill supernumerary temporary positions.
